Please read these Terms of Service (“Terms”) carefully before using unbranded-skin.com (the “Site”), operated by Unbranded Skin LLC, a Nevada limited liability company (“Unbranded Skin,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you are under 18, you may use the Site only with the involvement of a parent or guardian.
2. Your account
You may browse the Site without an account, but checkout requires you to provide accurate contact and shipping information. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account.
3. Orders and payment
All prices are listed in U.S. dollars (USD). Applicable sales tax is calculated at checkout based on your shipping address. We accept payment through Stripe and PayPal; by submitting your order you authorize the corresponding charge. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including for suspected fraud, payment failure, pricing errors, or stock limitations.
4. Pricing and product information
We try to keep all prices, descriptions, and ingredient lists accurate. In the event of a typographical error or pricing mistake, we reserve the right to cancel any affected order before shipment. Product photography is illustrative; actual color, packaging, or fill may vary slightly.
5. Shipping
Shipping rates, transit times, and supported destinations are set out on our Shipping & Returns page, which is incorporated into these Terms by reference. Risk of loss passes to you when the carrier accepts your package.
6. Returns
Our return policy is set out on the Shipping & Returns page. In summary: unopened products may be returned within 30 days of delivery; opened cosmetics are not eligible for return for hygiene reasons. Defective or damaged items will be replaced or refunded at no cost to you.
7. Cosmetic-product disclaimer
UNBRANDED SKIN products are cosmetics, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. The information on the Site is for general informational purposes only and is not a substitute for professional medical or dermatological advice. Always patch test new products before full use. Discontinue use and consult a healthcare professional if irritation occurs. Review the full ingredient list before purchase if you have known allergies or sensitivities.
8. Intellectual property
All content on the Site — including text, photography, the “UNBRANDED” name and logo, the six-color motif, and product packaging — is owned by Unbranded Skin LLC or licensed to us and is protected by copyright, trademark, and other laws. You may not reproduce, modify, distribute, or use any content for commercial purposes without our prior written consent.
9. Prohibited conduct
- Reselling our products through unauthorized channels;
- Scraping, data mining, or interfering with the Site’s operation;
- Submitting false or fraudulent orders;
- Uploading malware, harassing other users, or violating any law.
10. User-submitted content
If you submit a review, photo, or other content to us, you grant Unbranded Skin LLC a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with our business. You represent that you own the content and that it does not violate anyone else’s rights.
11. Disclaimers
The Site and our products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties — express, implied, statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by law, in no event will Unbranded Skin LLC, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or our products. Our total liability for any claim arising out of or relating to these Terms or the Site shall not exceed the amount you paid us for the order giving rise to the claim, or USD $100, whichever is greater.
13. Indemnification
You agree to indemnify and hold Unbranded Skin LLC harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your home jurisdiction.
15. Changes to these Terms
We may update these Terms at any time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the new Terms.
